Montana’s governor Steve Bullock has signed two separate bills that have been introduced to further improve the state’s regulatory environment for captive insurance.
HB 536 will authorise public sector entities in Montana to establish captive insurance companies, while HB 537 clarifies existing statutes to specify that captive insurance companies can be set up as limited liability companies (LLCs).
Montana's captive insurance code has been amended in previous sessions to allow captives to be formed as LLCs, but a corresponding change was not made to Montana's corporate laws.
HB 537 therefore amends the corporate code to correct the disparity between the corporate code and the captive code.
